<description><![CDATA[<p>Dear EBA Members,</p><p><img alt="" src="https://www.envirobank.org/resource/resmgr/2016_summer_conference/2016_summer_presenters/jansheinson.jpg" style="float: right; margin-left: 10px;" />After a 42-year career that includes 31 years as an environmental risk manager with JP Morgan Chase and legacy organizations, and BMO Bank N.A., I decided to retire effective January 2, 2025.<br />&nbsp;<br />For those who may not know, I began my career in 1981 in the oil and gas industry in Tulsa, OK and Houston, TX as an exploration geophysicist. I later worked as an environmental consultant for several environmental consulting firms from 1987 to 1992.&nbsp; I began my environmental risk management (ERM) career in banking in late 1993 at American National Bank (a subsidiary of First Chicago Bank) where I created and managed an ERM and technical review team. In 1999, when First Chicago was acquired by Bank One, I integrated the legacy ERM policies and procedures and managed a 7-person ERM team in Chicago, OH and TX. In 2003, when Bank One was acquired by JPMorgan Chase, I became the National Environmental Risk Manager and again integrated legacy ERM policies and procedures and managed an 11-person ERM team serving all lines of business for Chase's national footprint.<br />&nbsp;<br />In 2012, I joined BMO Bank N.A. to establish an ERM function and become the Environmental Risk Manager. I held that role ever since and had served as the sole BMO-employed environmental risk reviewer, advisor, and consultant until early 2022 when I hired Kip Kerecman as a senior environmental risk reviewer. <description><![CDATA[<p><img alt="" src="https://www.envirobank.org/resource/resmgr/publications/journal_images/pfas_corner.png" style="width: 200px; height: 279px; float: left; margin-right: 10px;" />On May 8, 2024, the US Environmental Protection Agency (EPA) published a new rule in the <strong><span style="text-decoration: underline;"><a href="https://www.federalregister.gov/documents/2024/02/08/2024-02324/listing-of-specific-pfas-as-hazardous-constituents" target="_blank">Federal Register</a></span></strong> designating two poly-fluoroalkyl substances (PFAS) as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as Superfund.&nbsp;&nbsp;&nbsp; </p><p>The decision for CERCLA designation was <a href="https://www.envirobank.org/news/670482/Critical-Rule-to-Clean-up-PFAS-Contamination-to-Protect-Public-Health-.htm" target="_blank">first announced on April 19, 2024</a>, but with this publication, the 60-day implementation clock formally begins. As of Monday, July 8, 2024, all AAI-compliant environmental due diligence reports will be required to address these two PFAS compounds as they would any other CERCLA regulated hazardous substance, rather than as an emerging contaminant. <title>Critical Rule to Clean up PFAS Contamination to Protect Public Health  </title>

<description><![CDATA[<p><span style="font-size: 14px;"><img alt="" src="https://www.envirobank.org/resource/resmgr/publications/journal_images/pfas_corner.png" style="width: 200px; height: 279px; float: left; margin-right: 10px;" />Earlier today, April 19, 2024, the US Environmental Protection Agency (EPA) finalized a long-anticipated ruling to designate two poly-fluoroalkyl substances (PFAS) – specifically, perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS) - as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as Superfund.<br /><br />As such, moving forward, All Appropriate Inquiries (AAI) dictates that consideration of PFAS will be required in the context of the performance of environmental due diligence. It remains to be seen what the broader implications for commercial real estate transactions will be, or if Phase I Environmental Site Assessments (ESAs) that are currently underway must be adjusted to incorporate PFAS as something other than an emerging contaminant. Regardless, practitioners of ESAs should discuss this news with their clients (and vice-versa) to make sure the expectations are clear.<br /><br />ASTM E1527-21 states in Appendix 6.10 that “If and when such emerging contaminants are defined to be a hazardous substance under CERCLA, as interpreted by EPA regulations and the courts, such substances shall be evaluated within the scope of this practice.”<br /><br />Releases and likely releases of PFOA and PFOS may now be considered RECs. The rule will be effective 60 days after the rule is published in the Federal Register. (APRIL 19, 2024) – Today, April 19, 2024, the U.S. Environmental Protection Agency (EPA) is taking another step in its efforts to protect people from the health risks posed by exposure to “forever chemicals” in communities across the country. Exposure to per-and polyfluoroalkyl substances (PFAS) has been linked to cancers, impacts to the liver and heart, and immune and developmental damage to infants and children. This final rule will designate two widely used PFAS chemicals, perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS), as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as Superfund, and will help ensure that polluters pay to clean up their contamination.<br /><br />This final action will address PFOA and PFOS contamination by enabling investigation and cleanup of these harmful chemicals and ensuring that leaks, spills, and other releases are reported. This action builds on the recently finalized standards to protect people and communities from PFAS contamination in drinking water and represents the latest step the Biden-Harris Administration is taking to protect public health and welfare and the environment under <a href="https://www.epa.gov/pfas/pfas-strategic-roadmap-epas-commitments-action-2021-2024" target="_blank">EPA’s PFAS Strategic Roadmap</a> and to prevent cancer before it starts through the Biden Cancer Moonshot.<br /><br />In addition to the final rule, EPA is issuing a separate <a href="https://www.epa.gov/enforcement/pfas-enforcement-discretion-and-settlement-policy-under-cercla" target="_blank">CERCLA enforcement discretion policy</a> that makes clear that EPA will focus enforcement on parties who significantly contributed to the release of PFAS chemicals into the environment, including parties that have manufactured PFAS or used PFAS in the manufacturing process, federal facilities, and other industrial parties.<br /><br />“President Biden understands the threat that “forever chemicals” pose to the health of families across the country. That’s why EPA launched its PFAS Strategic Roadmap, a whole-of-agency approach to protecting public health and addressing the harm to communities overburdened by PFAS pollution,” <strong>said EPA Administrator Michael S. Regan</strong>. “Designating these chemicals under our Superfund authority will allow EPA to address more contaminated sites, take earlier action, and expedite cleanups, all while ensuring polluters pay for the costs to clean up pollution threatening the health of communities.”<br /><br />EPA is taking this step to designate PFOA and PFOS under CERCLA because both chemicals meet the statutory criteria for designation as hazardous substances. Under the rule, entities are required to immediately report releases of PFOA and PFOS that meet or exceed the reportable quantity of one pound within a 24-hour period to the National Response Center, State, Tribal, and local emergency responders. The designation of PFOA and PFOS as hazardous substances under CERCLA enables the agency to use one of its strongest enforcement tools to compel polluters to pay for or conduct investigations and cleanup, rather than taxpayers. Designation is especially important as delay in addressing contamination allows PFOA and PFOS more time to migrate in water and soil, worsening existing contamination.<br /><br />The final rule also means that federal entities that transfer or sell their property must provide notice about the storage, release, or disposal of PFOA or PFOS on the property and guarantee that contamination has been cleaned up or, if needed, that additional cleanup will occur in the future. It will also lead the Department of Transportation to list and regulate these substances as hazardous materials under the Hazardous Materials Transportation Act.<br /><br />“It’s long past time for the polluters who poisoned all of us to be held responsible. This comes too late for all the people who were poisoned without their knowledge or consent and have paid the price for one of the greatest environmental crimes in history,” <strong>said Ken Cook, President and co-founder of Environmental Working Group</strong>. “But today’s designation of PFOA and PFOS as hazardous substances is the first step to bring justice to those who have been harmed. By putting the needs of the people ahead of the profits of the polluters, the Biden EPA is once again delivering for the American people.”<br /><br />This final action is based on significant scientific evidence that these substances, when released into the environment, may present a substantial danger to public health or welfare or the environment. PFOA and PFOS can accumulate and persist in the human body for long periods of time, and evidence from scientific studies demonstrate that exposure to PFOA and PFOS is linked to adverse health effects.<br /><br />“This is another important step by EPA to protect people and communities from harmful PFAS chemicals, including legacy PFAS contamination across the U.S. The science is clear that PFAS chemicals are linked to a wide range of health harms including cancer, damage to cardiovascular and immune systems, poor pregnancy outcomes, and effects on the developing child,” <strong>said Dr. Tracey Woodruff, Professor &amp; Director, Program on Reproductive Health &amp; the Environment (PRHE)/Environmental Research and Translation for Health at the University of California, San Francisco</strong>. “By listing PFOA and PFOS as hazardous substances under the Superfund Law, it means that these chemicals will have to be cleaned up from hazardous waste sites and polluters must pay the bill. This is great news for the many communities grappling with PFAS contamination – many of which are also low income and communities of color. This is another step toward protecting people from the health harms of this well-known toxic chemical.”<br /><br />EPA’s Superfund program has worked effectively for more than 40 years to target and prioritize cleanups of the nation’s most contaminated sites that present unacceptable risks to human health and the environment. The Superfund program addresses more than 800 hazardous substances, including widespread, highly mobile, and persistent chemicals, like PFOA and PFOS. The program also promotes safer industrial practices that enhance community protections by reducing the likelihood of future releases. Additionally, cleanups allow communities to put land back into productive use, providing opportunities for jobs and economic growth.<br /><br />In addition, EPA’s enforcement policy, consistent with EPA’s past practice over decades of implementing the law, will provide additional clarity on the agency’s intent not to pursue certain parties such as farmers, municipal landfills, water utilities, municipal airports, and local fire departments, where equitable factors do not support seeking CERCLA cleanup or costs. EPA has a proven track record of developing and applying enforcement discretion policies that are effective and well-received by stakeholders, ensuring entities that have contributed significant contamination are held accountable.<br /><br /></p><h5 style="text-align: left;">Biden-⁠Harris Administration Takes Critical Action to Protect Communities from PFAS</h5><p style="text-align: left;">In addition to efforts across the government, EPA has taken action under the agency’s <a href="https://www.epa.gov/pfas" target="_blank">PFAS Strategic Roadmap</a> to control PFAS at its sources, hold polluters accountable, ensure science-based decision making, advance environmental justice, and address the impacts on disadvantaged communities. Since launching the <a href="https://www.epa.gov/pfas/pfas-strategic-roadmap-epas-commitments-action-2021-2024" target="_blank">Roadmap</a> in 2021, EPA has taken a suite of actions to protect communities from exposure to “forever chemicals” including:<br /></p><ul><li style="text-align: left;"><em>Established first-ever national legally enforceable drinking water standard for PFAS:</em> In April 2024, EPA finalized National Primary Drinking Water Regulation (NPDWR) for six PFAS which will protect 100 million people from PFAS exposure, prevent tens of thousands of serious illnesses, and save lives. This action complements the Biden-Harris Administration’s commitment to combatting PFAS pollution and delivering clean water.</li><li style="text-align: left;"><em>Dedicated $9 billion in funding to address PFAS and other emerging contaminants in drinking water:</em> President Biden’s Bipartisan Infrastructure Law secured the largest-ever investment in tackling PFAS pollution in drinking water. An additional $12 billion in funding from the Bipartisan Infrastructure Law supports general drinking water investments, including PFAS treatment. The investments are part of the <a href="https://www.whitehouse.gov/environmentaljustice/justice40/" target="_blank">Justice40 Initiative</a>, which aims to ensure that 40 percent of the overall benefits of certain federal investments flow to disadvantaged communities. </li><li style="text-align: left;"><em>Guidance on Destroying and Disposing of PFAS:</em> EPA released updated Interim Guidance which outlines the best-available science on techniques and treatments that may be used to destroy or dispose of PFAS and PFAS-containing materials from non-consumer products, including aqueous film-forming foam for firefighting, and highlights innovation and emerging technologies that warrant further evaluation.</li><li style="text-align: left;"><em>Addressing on-going uses of PFAS:</em> In January 2024 EPA finalized a rule that prevents companies from starting or resuming the manufacture or processing of 329 PFAS; released three methods to better measure PFAS in the environment; and announced the addition of seven PFAS to the list of chemicals covered by the Toxics Release Inventory (TRI), consistent with the Fiscal Year 2020 National Defense Authorization Act.<br /></li></ul><p style="text-align: left;"><span style="font-size: 14px;">EPA will publish the Final Rule in the <em>Federal Register</em> shortly. <title>EBA Journal Spotlight</title>

<description><![CDATA[<h2>Bring Your Content Ideas to Fruition and Become a Published Author!</h2><p><span style="font-size: 14px;"><i>by Tammy Ribaudo, with introduction by Lizz Barringer Lagomarsino and Elizabeth Krol</i></span></p><p>&nbsp;</p><h6>Introduction<br /></h6><p>The Environmental Bankers Association (EBA) has been a leader in providing industry news, information and technical updates critical to the environmental risk management community since its formation more than 25 years ago. The original Bank Notes periodic newsletter was enhanced in 2015 when the EBA News Committee was formed and began the formal publication of the <u>EBA Journal</u>. <br /><br />The <u>EBA Journal</u> spotlights and reflects the expertise of our members, while also serving as an important platform to help our members improve their effectiveness in their respective roles. In addition, the <u>EBA Journal</u> is both a valued member benefit and a recruitment tool to invite new lenders and affiliates to join our esteemed organization. <br /><br />EBA members have been contributing content throughout the <u>EBA Journal</u>’s history, yet we know that there are members who may be reticent to participate. So, for those of you who have ever wanted to contribute to the <u>EBA Journal</u> but just don’t know where to start, or perhaps you are a technical person looking to utilize your creative writing skills, we can help! As the <u>EBA Journal</u> continues to evolve in 2021, we intend to continue to create a document with more and intriguing content for our members.<br /><br /></p><h6>How can you get started writing an article for the <u>EBA Journal</u>?<br /></h6><p>I recently shared with EBA members how to bring an idea to fruition so that more members can contribute and become published authors. Here we provide an overview of my recommendations for writing topical and technical content for the <u>EBA Journal</u>, including insights on how to turn your idea into an article.</p><p>One place to begin might be to focus on the goals of your personal thought leadership. All true thought leadership should address the following:<br /><br /></p><ul><li>Fill a void important to your industry that impacts your target audience </li><li>Address a key business or customer issue </li><li>Help your target audience navigate new rules or regulations </li><li>Share a best practice or lessons learned </li><li>Share a perspective on a trend impacting your industry </li><li>Describe an approach</li></ul><p><br />Where do you start? The most readily accessible source is you! Think about the types of articles you most relate to and determine what is it you like about them. It’s also vital to know your strengths and audience. Where are you viewed as the expert? How can you help your audience gain value from your expertise? One of EBA’s most valued attributes is the contributions of the community to support the property due diligence industry. Our members are widely regarded as thoughtful, generous thought leaders and practitioners in our field, and our collaborative spirit is what sets us apart from other risk management organizations.<br /><br />Next, do some thinking and scanning. Define your target audience. Are you speaking directly to lenders, to consultants or affiliates, or both? Determine your topic and think through what’s needed to create value for your target audience. Identify the objective and key contents for your piece and gain buy-in from respected colleagues and/or your company’s marketing team. Scan the market to make sure your perspective is relevant, new, different, and/or more targeted.<br /><br /></p><h6>Key Steps to Hone Your Message</h6><p><img alt="" src="https://www.envirobank.org/resource/resmgr/publications/journal_images/journal_graph1.png" style="width: 624px; height: 356px;" /><br /></p><p>Another important step is to add research for added credibility. What is going to attract the audience to your article? </p><ul><li>Highlight your personal experiences</li><li>Use numbers, graphs, charts </li><li>Create intrigue or surprise </li><li>Create a curiosity gap </li><li>Think about a different angle on something well known</li><li>Watch your language <ul><li>Trim excess adverbs like very, really </li><li>Be bold, confident </li><li>Use verbs and an active voice </li></ul></li></ul><p>&nbsp;</p><h4>Bring it all together <br /></h4><h4><img alt="" src="https://www.envirobank.org/resource/resmgr/publications/journal_images/journal_graph3.png" style="width: 624px; height: 347px;" /></h4><h4><br /></h4><h4>Tips and Tricks<br /></h4><p>Insert quotes from an EBA member that you interviewed for your article, emulate the style of an article you enjoyed, share your own story, and speak in the first person. Speaking in the first person can be most effective for non-technical and regulatory topics. Effective visual references might include maps, graphs, and photos. <br /><br />When you write and re-write to get your article just right, it is important to consider the elements of a story that will keep your reader engaged. <br /><br />Your story should have some tension or catch to keep the reader paying attention. Create an emotional connection and establish yourself as the authority. Be relatable, surprising, funny, intriguing, inspirational, timely, trendy, and helpful. Differentiate yourself to stand out and create a takeaway point and repeat that message to make your point.<br /><br />Also, keep the following tools and techniques handy.<br /><br /></p><ul><li>Use active voice as passive voice downplays your message.<ul><li>Active: ABC Industries contaminated the drinking water with blinker fluid.</li><li>Passive: Blinker fluid contamination is present in the drinking water, which is attributable to ABC Industries.<br /></li></ul></li></ul><p><br />Writers can, however, use to passive voice to intentionally communicate their purpose.<br /><br /></p><ul><li>Try interesting verbs and don’t lean on adverbs. <ul><li>“The EBA Journal is innovative and contains very synergistic articles.” While correct in what it is saying, innovative and synergistic are overused and very synergistic is the same as synergistic.</li></ul></li><li>Long sentences can bury the point and lose the reader. Get right to the point and back up points with facts. Describe what is “innovative” about the solution and what it will do for the reader.</li><li>In the end, read your writing out loud to confirm it would flow to the listener. And, use a style guide or the internet to help you confirm word use, sentence structure, and punctuation.<br /></li></ul><p><br />It’s important to note that various content types are welcome in the <u>EBA Journal</u>. Examples include case studies for the <i>Case Corner</i>; Lender Insights shared in the <i>Ask a Banker</i> feature; updates pertaining to regulatory changes and/or industry hurdles, technical and regulatory content; and best practices, job aides and lessons learned. Content type and length may vary based upon the subject matter, layout, and author’s preference. General <u>EBA Journal</u> guidelines recommend a target word count for article contributions of between 800 and 2,500. To put that in context, one full page of <u>EBA Journal</u> text is approximately 500 words. Short format content, such as a Top 5 list, which may be only ½ page in length is also welcome. For recent examples, and to generate some ideas, visit the <u>EBA Journal</u> page on the EBA website to peruse prior editions to get ideas about content, format, and style.<br /><br /><a href="https://www.envirobank.org/page/EBAJournals" target="_blank">https://www.envirobank.org/page/EBAJournals</a><br /><br />In our current digital age, emphasis is placed on both incorporating a catchy title to grab the reader’s attention, as well as driving traffic from LinkedIn posts to the EBA website to draw in prospective members. For future editions, EBA may select a few articles to post on social media with proper citations for the authors, as well as encourage presenters at our conferences to repurpose their content into an <u>EBA Journal</u> article. This dual purpose will provide great visibility to the authors as well as EBA.<br /><br />The <u>EBA Journal</u> Committee is here to support you on your journey to become a published author.
